We are also exempt from all liability for any damage or loss the user may suffer as a result of errors, defects or omissions in the information we provide when it comes from sources other than ourselves.<\/p>

9. PURCHASE PROCESS
Users may purchase on the Website by the means and methods established. They must follow the Jewels and Wine online purchase and\/or acquisition procedure, during which various products and\/or services may be selected and added to the cart, basket or final purchase area and, finally, click on \u00abbuy\u00bb.
The User must also fill in and\/or check the information requested at each step, although, during the purchase process and before payment, the purchase details may be modified.
Once the order has been placed, a confirmation email should be received setting out the general terms of contract.
Once the purchase procedure has been completed, the User consents to the Website generating an electronic invoice, which will be sent to the User by email and, where applicable, through their personal account area on the Website. The User may also, if they wish, obtain a paper copy of their invoice by requesting it from facturas@jewelsandwine.com, using the contact areas of the Website or the contact details provided above.
The User acknowledges being aware, at the time of purchase, of certain particular conditions of sale concerning the product and\/or service in question, which are displayed alongside its presentation or, where applicable, its image on its page of the Website, indicating, by way of example but not limited to, and depending on the case: name, price, components, weight, quantity, colour, product details or features, how the services will be provided and\/or their cost; and acknowledges that placing the purchase or acquisition order constitutes full and complete acceptance of the particular conditions of sale applicable in each case.

10. AVAILABILITY
All purchase orders received by JEWELS AND WINE through the Website are subject to the availability of the products and\/or to no circumstance or cause of force majeure (clause 15 of these Conditions) affecting their supply and\/or the provision of the services.
Should there be difficulties with the supply of products or should products be out of stock, JEWELS AND WINE undertakes to contact the User and refund any amount that may have been paid. This shall also apply where the provision of a service becomes impossible.<\/p>

11. PRICES AND PAYMENT METHODS
The prices displayed on the Website are final prices, in Euros (\u20ac), and include taxes, unless otherwise indicated and applied due to legal requirements, particularly in relation to VAT.<\/p>

CANCELLATION COSTS ARE NOT INCLUDED<\/p>

However, unless otherwise indicated on a specific occasion, the prices of the items offered exclude any cancellation costs that may be incurred, which will be added to the total amount due at the time the User processes the cancellation procedure.
Under no circumstances will the Website automatically add additional costs to the price of a product or service, but only those that the User has voluntarily and freely selected and chosen.
Prices may change at any time, but any changes will not affect orders or purchases for which the User has already received an order confirmation.
Accepted payment methods are: credit or debit card, PayPal, Apple Pay.
JEWELS AND WINE uses all means to guarantee the confidentiality and security of the payment data transmitted by the User during transactions through the Website. To this end, the Website uses a secure SSL (Secure Socket Layer) payment system.<\/p>

A) CREDIT CARDS
Credit cards are subject to checks and authorisation by the issuing bank. If the bank does not authorise the payment, JEWELS AND WINE will not be responsible for any delay or failure to deliver and will not be able to enter into any contract with the User.
Once JEWELS AND WINE receives the User's purchase order through the Website, a pre-authorisation will be made on the relevant card to ensure there are sufficient funds to complete the transaction. The card will be charged when the User is sent the shipping confirmation and\/or confirmation of the service provided in the established manner and, where applicable, place.<\/p>

B) PAYPAL
If the payment method is PayPal, the charge will be made when JEWELS AND WINE sends the User confirmation of the purchase order or acquisition of products and\/or services.<\/p>

C) APPLE PAY
If the payment method is Apple Pay, the charge will be made when JEWELS AND WINE sends the User confirmation of the purchase order or acquisition of products and\/or services.<\/p>

12. DELIVERY
Where physical delivery of the contracted goods is applicable, deliveries will be made within the following territory: Spain (Mainland and Balearic Islands).
Except where there are unforeseen or extraordinary circumstances or, where applicable, circumstances arising from the personalisation of the products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the period indicated on the Website according to the shipping method selected by the User and, in any case, within a maximum of 30 calendar days from the date of order confirmation.
If, for any reason attributable to it, JEWELS AND WINE is unable to meet the delivery date, it will contact the User to inform them of this and the User may choose to proceed with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. In any case, home deliveries are made on working days.
If it is impossible to deliver the order because the User is absent, the order may be returned to the warehouse. However, the carrier will leave a notice explaining where the order is and how to arrange for it to be delivered again.
If the User will not be at the delivery address during the agreed time slot, they must contact JEWELS AND WINE to arrange delivery on another day.
If 30 days pass from the time your order is available for delivery and it has not been delivered for reasons not attributable to JEWELS AND WINE, JEWELS AND WINE will understand that the User wishes to withdraw from the contract and it will be deemed terminated. As a consequence of the termination of the contract, all payments received from the User will be refunded, except for any additional costs resulting from the User's own choice of a delivery method other than the least expensive standard delivery offered by the Website, without undue delay and, in any case, within a maximum of 14 calendar days from the date on which the contract is deemed terminated.
However, the User should bear in mind that transport arising from the termination may involve an additional cost that may be passed on to them.
For the purposes of these Conditions, delivery shall be deemed to have taken place, or the order to have been delivered, when the User or a third party designated by the User takes physical possession of the products, which will be evidenced by signing for receipt of the order at the agreed delivery address.
Any risks arising from the products shall be borne by the User from the time of delivery.
The User acquires ownership of the products when JEWELS AND WINE receives full payment of all amounts due in relation to the purchase or acquisition made, including shipping costs, or at the time of delivery, if this takes place after JEWELS AND WINE has received the full amount payable.
In accordance with Law 37\/1992 of 28 December on Value Added Tax (VAT), purchase orders for delivery and\/or provision shall be deemed to be located within the territory where Spanish VAT applies if the delivery address is in Spanish territory, except the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be the one legally in force at any given time depending on the specific item concerned.<\/p>

13. TECHNICAL MEANS TO CORRECT ERRORS
The User is hereby informed that, should they detect that an error has occurred when entering the data required to process their purchase request on the Website, they may modify it by contacting JEWELS AND WINE through the contact areas provided on the Website and, where applicable, through those provided for contacting customer service, and\/or using the contact details provided in the first clause (General Information).
In any case, before clicking \u00abbuy\u00bb, the User has access to the area, cart or basket where their purchase requests are recorded and may make changes.
Likewise, the User is referred to the Privacy Policy for further information on how to exercise their right of rectification under Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and Organic Law 3\/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights.<\/p>

14. RETURNS
Where the User purchases products on or through the owner's Website, they have a number of rights, as listed and described below:<\/p>

Right of Withdrawal
The User, as a consumer and user, makes a purchase on the Website and is therefore entitled to withdraw from that purchase within 14 calendar days without giving any reason.
This withdrawal period will expire 14 calendar days from the day on which the User, or a third party authorised by the User other than the carrier, took physical possession of the goods purchased on the JEWELS AND WINE Website or, if the goods making up the order are delivered separately, 14 calendar days from the day on which the User, or a third party authorised by the User other than the carrier, took physical possession of the last of the goods making up the same purchase order, or, in the case of a service contract, 14 calendar days from the day the contract was concluded.
To exercise this right of withdrawal, the User must notify JEWELS AND WINE of their decision. They may do so, where applicable, through the contact areas provided on the Website or via: madrid@jewelsandwine.com.
Regardless of the means chosen to communicate their decision, the User must clearly and unequivocally state their intention to withdraw from the purchase contract. In any case, the User may use the model withdrawal form that JEWELS AND WINE makes available as an annex to these Conditions; however, its use is not mandatory.
To meet the withdrawal deadline, it is sufficient for the communication unequivocally expressing the decision to withdraw to be sent before the relevant period expires.
In the event of withdrawal, JEWELS AND WINE will refund the User all payments received, including delivery costs (with the exception of additional costs chosen by the User for a delivery method other than the least expensive one offered on the Website), without undue delay and in any case no later than 14 calendar days from the date on which JEWELS AND WINE is informed of the User's decision to withdraw.
JEWELS AND WINE will refund the User using the same payment method used for the initial purchase transaction. This refund will not incur any additional cost for the User. However, JEWELS AND WINE may withhold the refund until it has received the products or items purchased, or until the User provides proof of having returned them, whichever condition is met first.

And must do so without undue delay and, in any case, no later than 14 calendar days from the date on which JEWELS AND WINE was informed of the decision to withdraw.
The User acknowledges that they must bear the direct cost of returning the goods (transport, delivery), if any is incurred.
In addition, they will be liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
The User acknowledges being aware that there are exceptions to the right of withdrawal, as set out in article 103 of Royal Legislative Decree 1\/2007 of 16 November approving the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws. By way of example, and not limited to, this would be the case for: personalised products; products that may deteriorate or expire rapidly; music or video CDs\/DVDs without their factory-sealed packaging; products that are sealed for health or hygiene reasons and have been unsealed after delivery.
The provision of any service that the User may contract on this Website is governed in the same way, as the same Law establishes that Users shall not have the right of withdrawal when the service has been fully performed, or when performance has begun with the express consent of the consumer and user and with their acknowledgement that they are aware that, once the contract has been fully performed by Jewels & Wine, they will have lost their right of withdrawal.
In any case, no refund will be made if the service is cancelled within 72 hours of the event.<\/p>

15. EXCLUSION OF LIABILITY
Unless otherwise provided by law, JEWELS AND WINE will not accept any liability for the following losses, whatever their origin:
(i) any losses not attributable to any breach on its part;
(ii) business losses (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or unnecessary expenses incurred); or
(iii) any other indirect loss that was not reasonably foreseeable by both parties at the time the contract for the sale of the products was entered into between them.
JEWELS AND WINE also limits its liability in the following cases:
(i) JEWELS AND WINE takes every measure to provide an accurate display of the product on the Website; however, it is not responsible for minor differences or inaccuracies that may exist due to insufficient screen resolution, problems with the browser used or other issues of this kind.
(ii) JEWELS AND WINE will act with the utmost diligence to make the product covered by the purchase order available to the company responsible for transporting it. However, it is not responsible for damage resulting from transport malfunctions, particularly due to causes such as strikes, road delays and, in general, any others typical of the sector, which result in delays, loss or theft of the product.
(iii) Technical failures which, due to chance or other causes, prevent the normal operation of the service via the Internet. Unavailability of the Website for maintenance or other reasons, preventing the service from being used. JEWELS AND WINE uses all means at its disposal to carry out the process of purchase, payment and shipping\/delivery of the products; however, it is exempt from liability for causes not attributable to it, fortuitous events or force majeure.
(iv) JEWELS AND WINE will not be responsible for the misuse and\/or wear and tear of products that have been used by the User. Nor will JEWELS AND WINE be responsible for an incorrect return made by the User. It is the User's responsibility to return the correct product.
(v) In general, JEWELS AND WINE will not be responsible for any breach or delay in fulfilling any of the obligations assumed when it is due to events beyond its reasonable control, i.e. due to force majeure, which may include, by way of example but not limited to:
– Strikes, lockouts or other industrial action.
– Civil commotion, riot, invasion, terrorist threat or attack, war (declared or not) or threat of or preparations for war.
– Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
– Inability to use trains, ships, aircraft, motor transport or other means of transport, public or private.
– Inability to use public or private telecommunications systems.
– Acts, decrees, legislation, regulations or restrictions of any government or public authority.
In this way, obligations will be suspended for the period during which the cause of force majeure continues, and JEWELS AND WINE will be granted an extension of the period to fulfil them equal to the duration of the force majeure.
JEWELS AND WINE will use all reasonable means to find a solution that allows it to fulfil its obligations despite the force majeure.<\/p>

16. WRITTEN COMMUNICATIONS AND NOTICES
By using this Website, the User agrees that most communications with JEWELS AND WINE will be electronic (email or notices published on the Website).
For contractual purposes, the User consents to the use of this electronic means of communication and acknowledges that all contracts, notices, information and other communications sent electronically by JEWELS AND WINE comply with the legal requirement of being in writing. This condition will not affect the User's statutory rights.
The User may send notices to and\/or communicate with JEWELS AND WINE using the contact details provided in these Conditions and, where applicable, through the contact areas of the Website.
Likewise, unless otherwise stipulated, JEWELS AND WINE may contact and\/or notify the User at their email address or the postal address provided.<\/p>

17. WAIVER
No waiver by JEWELS AND WINE of a specific right or legal action, or failure by JEWELS AND WINE to require strict performance by the User of any of their obligations, shall constitute a waiver of other rights or actions arising from a contract or the Conditions, nor shall it release the User from fulfilling their obligations.
No waiver by JEWELS AND WINE of any of these Conditions or of the rights or actions arising from a contract shall take effect unless it is expressly stated to be a waiver and is formalised and communicated to the User in writing.<\/p>

18. INVALIDITY
If any of these Conditions is declared null and void by a final decision of a competent authority, the remaining clauses will remain in force and will not be affected by that declaration of invalidity.<\/p>

19. ENTIRE AGREEMENT
These Conditions and any document expressly referred to in them constitute the entire agreement between the User and JEWELS AND WINE in relation to the subject of the sale and supersede any other prior agreement, arrangement or promise made verbally or in writing by the same parties.
The User and JEWELS AND WINE acknowledge that they have agreed to enter into a contract without having relied on any statement or promise made by the other party, except as expressly mentioned in these Conditions.<\/p>

17. APPLICABLE LAW AND JURISDICTION
Access to, browsing and\/or use of this Website and contracts for the purchase of products through it shall be governed by Spanish law.
Any dispute, problem or disagreement arising from or related to access to, browsing and\/or use of the Website, or the interpretation and performance of these Conditions, or the sale contracts between JEWELS AND WINE and the User, shall be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals, the competent forum being that of the user's place of residence.<\/p>

Likewise, if a dispute arises from the conclusion of this purchase contract between JEWELS AND WINE and the User, the User as a consumer may request an out-of-court dispute resolution in accordance with Regulation (EU) 524\/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) 2006\/2004 and Directive 2009\/22\/EC.
